State of Florida Legal Burn Requirements

You may burn yard waste (NOT household garbage, household paper products, treated lumber, plastics, rubber materials, tires, pesticides, paint, and aerosol containers) without authorization only if:

  1. No local or county ordinance prohibits such burning (Charlotte County allows such burning)
  2. Meet the set-backs listed below
  3. Fire is started after 9:00 a.m. and is out 1 hour before sunset
  4. The yard waste is in an 8-foot diameter pile OR a non-combustible container covered with wire mesh
  5. Fire is attended at all times.
  6. In Charlotte County you must have an on-site water source for extinguishment.

State of Florida Legal Burn Requirements

You may burn yard trash or household paper products (but not garbage) without authorization only if:

  1. The burn must be at least 50 feet from any paved public roads.
  2. The burn must be in an 8-foot diameter pile OR a non-combustible container covered with wire mesh.
  3. The burn must be at least 25 feet from your home
  4. The burn must be at least 150 feet from any other occupied buildings
  5. The burn must be at least 25 feet from any forest or wildland areas. (including vacant lots)

IF YOUR FIRE ESCAPES, YOU WILL BE LIABLE FOR SUPPRESSION COSTS AND DAMAGE TO THE PROPERTY OF OTHERS
