Who & What Requires a Permit
Building code requirement from the 2007 Florida Building Code reads as follows:
PERMIT APPLICATION
104.1.1 When Required. Any owner, or contractor who desires to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install enlarge, alter repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by the technical codes, or to cause any such work to be done, shall first make application to the Building Official and obtain the required permit for the work.
EXCEPTION: Permits shall not be required for the following mechanical work:
- Any portable heating appliance;
- Any portable ventilation equipment;
- Any portable cooling unit;
- Any steam, hot or chilled water piping within any heating or cooling equipment regulated by this Code;
- Replacement of any part which does not alter its approval or make it unsafe;
- Any portable evaporative cooler;
- Any self-contained refrigeration system containing 10 lb (4.54 kg) or less of refrigerant and actuated by motors of 1 horsepower (746 W) or less.
- The installation, replacement, removal or metering of any load management control device.
Work Not Requiring a Permit
- Sidewalk which is not covered (must be individually reviewed, may require a Right Of Way Permit).
- Fascia and gutters (private residence only)
- Minor interior work under $100.00-non structural only (must be individually reviewed).
- Tents which are 400 sq. ft. or less and will not be used to seat more than 50 persons.
- Pasture/wire mesh fencing on acreage.
- Split rail fence.
- Stucco or painting private residences.
- Non-residential farm buildings on parcels which exceed 40 acres and has no electric, mechanical or plumbing. Parcel must have agricultural exemption in accordance with F.S. 193.461 (ordinance 83-11, section 11).
- Residential landscaping, excluding sprinklers.
- Residential carpeting and/or paneling.
- Residential satellite dishes (concrete slab must have permit)
- Screening existing front entry, where no structural work is to be added, i.e. aluminum and/or wood posts.
- Asphalt or gravel driveways (must be individually reviewed, may require a Right Of Way Permit).
- Awnings (wall mounted only).
- Commercial Flag Pole.
- Tile, River rock and re-screening.

The 2007 Florida Building Code goes into effect on March 1 2009. All applications received on or after that date will be subject to review under the provisions of the 2007 Florida Building Code.
In addition, all permits that are showing as expired on March 1, 2009 will be subject to further review and inspection to ensure that the proposed work is compliant with the requirements of the 2007 Florida Building Codes. At a minimum, all work that has not yet passed inspection WILL be required to meet the provisions of the 2007 Florida Building Codes.
This is in accordance with the following:
105.4.1.2 If a new permit is not obtained within 180 days from the date the initial permit became null and void, the building official is authorized to require that any work which has been commenced or completed be removed from the building site. Alternately, a new permit may be issued on application, providing the work in place and required to complete the structure meets all applicable regulations in effect at the time the initial permit became null and void and any regulations which may have become effective between the date of expiration and the date of issuance of the new permit.
